Utah Legislator Introduces 3 Bills to Dehumanize LGBT Citizens

Utah state legislator LaVar Christensen (R-Draper)  has introduced three bills since Jan 24 taking direct aim at the Utah LGBT community.  Each bill separately strips rights away from LGBT living in the state, and together are nothing less than an act of hate, bigotry and the dehumanization of Utah’s LGBT Citizens.

If Christensen is successful LGBT Utahn’s would be unable to protect themselves contractually in retirement planning, wills and estate planning.  Basically it would prohibit LGBT couples from entering into any contract together.  LGBT couples and couples with children could not be recognized as a family in the state of Utah and public funding for any effort would be in violation of that legislation.  Finally, it would ensure that LGBT citizens could be discriminated against, including termination at their jobs without legal retribution, effectively repealing the anti-discrimination ordinances of 11 Utah communities.  This man isn’t just a threat to the LGBT community, but to the Utah public as a whole.  He is boxing in who he thinks should raise children, who should marry, and who should enter into contracts.

Christensen’s bills attempt nothing less than the dehumanization of LGBT, repulsively similar to laws and proclamaitions of Nazi Germany  in 1934. HB 270, calls for Utah to endorse:

Marriage and family predate all governments and are supported by and consistent with the Laws of Nature and Nature’s God, the Creator and Supreme Judge of the World, affirmed in the nation’s founding Declaration of Independence. Marriage represents the legal sanction and approval of society and is essential to ordered liberty and public virtue. Procreation within marriage links generations and is fundamental to the perpetuity of humanity.

  

Nazi Max Von Gruber in his 1927 book Sexual Hygiene stated:

The purpose of marriage is the procreation of children and their upbringing. National growth requires marriage to produce at least four offspring.

Christensen’s other two bills call for the removal of anti-discrimination protections along the lines of religious beliefs.  This is the first step towards the Nazi’s Paragraph 175 which criminalized homosexual behavior and stripped homosexuals of civil rights earned in the early 1800’s.

Nazi Germany’s Paragraph 175 and subparts added imprisonment and the loss of civil rights for homosexuals.

Paragraph 175: A male who commits a sex offense with another male or allows himself to be used by another male for a sex offense shall be punished with imprisonment.

Where a party was not yet twenty-one years of age at the time of the act, the court may in especially minor cases refrain from punishment.

 

Paragraph 175a: Penal servitude up to 10 years or, where there are mitigating circumstances, imprisonment of not less than three months shall apply to: (1) a male who, with violence or the threat of violence to body and soul or life, compels another male to commit a sex offense with him or to allow himself to be abused for a sex offense; (2) a male who, by abusing a relationship of dependence based upon service, employment or subordination, induces another male to commit a sex offense with him or to allow himself to be abused for a sex offense; (3) a male over 21 years of age who seduces a male person under twenty-one years to commit a sex offense with him or to allow himself to be abused for a sex offense; (4) a male who publicly commits a sex offense with males or allows himself to be abused by males for a sex offense or offers himself for the same.

Paragraph 175b: An unnatural sex act committed by humans with animals is punishable by imprisonment; the loss of civil rights might also be imposed.

His first bill basically serves to make it illegal for same-sex couples to create contracts together. Specifically, HB 182 would bar same-sex couples from making any contractual agreementsin matters like wills and property. The bill first came to the Utah floor in 2006 as HB 304, but was narrowly defeated. Known as the “Voiding Transactions Against Public Policy”  bill, if it is passed it will strip even more rights away from the same sex couples who depend on contractual arrangements as defense against the fact that same sex couples in Utah already have very little protection. 

The second one, HB 270, calls for the endorsement of Utah to “hold marriage as legal and binding only between an a man and a woman as God created it.”  The end result of this bill would require all publicly funded programs, laws and regulations to exclude families headed by gay and lesbian couples. The bill states that “marriage and family predate all governments and are supported by and consistent with the Laws of Nature and God, the Creator and Supreme Judge of the World, affirmed in the nation’s founding Declaration of Independence.” It also says, “families anchored by both a father and a mother, fidelity within marriage, and enduring devotion to the covenants and responsibilities of marriage are the desired norm.”

His third, HB 109, seeks an amendment on existing anti-discrimination laws.  In short, any individual, corporation or company can fire or evict someone because they are lesbian, gay, bisexual or transgender without any penalties. Taken to it’s illogical conclusion, it is not that large of a shark to jump until discrimination against sex and possibly even race would be allowed on religious grounds.

Christensen states in his video incorrectly that children are best raised by parents consisting of a man and a woman, which is inconsistent with recent research.  Interestingly Christensen doesn’t have the guts to mention that his legislation is aimed directly at the LGBT community; he refers to ‘social forces’ instead.

This man thinly disguises his bigotry and hate.  It’s time for all Utahn’s who value our American heritage to speak out against LaVar Christensen.  He is taking this state down a slippery slope and inaction and silence only condone his behavior.   I’m reminded of a quote by Dr. Niemoller during the Nazi occupation of Germany First They Came:

First they came for the Socialists, and I did not speak out —

Then they came for the Jews, and I did not speak out —
Because I was not a Jew.
