EU Condemns ‘Phallometric Testing’ for Gay Asylum Seekers

Ummm.. Incase you couldn’t tell by the title, The Czech Republic is probably NOT the first place you want to go if you’re fleeing sexual orientation persecution… just sayin’

A new report by the European Union Agency for Fundamental Rights titled ‘Homophobia, transphobia and

Gay Testing

discrimination on grounds of sexual orientation and gender identity’ has condemned the use by the Czech Republic of ‘phallometric testing’ during the asylum procedure. This practice tests the physical reaction to heterosexual pornographic material of those who file a claim for asylum on the basis of their homosexual orientation.

The Agency says that it believes the practice could be in violation of Article 3 of the European Convention on Human Rights which prohibits torture and human or degrading treatment, and of Article 8, (respect of one’s private life), “since this procedure touches upon ‘a most intimate part of an individual’s private life’”.

Many European countries while open to providing asylum for individuals unable to live in their own country because of LGBT persecution are struggling with validating the claim.  Unfortunately governments haven’t solidified policy and procedure or leveraged education and awareness to a degree which educates interviewers to make a more accurate assessment than playing Daft Punk and evaluating how the respondent dances…   I recently read a case from Australia where an Iranian refugee was denied asylum because he failed the ‘gay’ quiz for not knowing who Madonna was..
